a. Personal Information
Customer, hereafter known as you, customers and defined as any person or organization that creates a Customer account on Floristweb.co.za, and/or purchases products from Floristweb.co.za.
Floristweb, hereafter known as Floristweb.co.za, We, Us and defined as Floristweb cc of PO BOX 15342, Vlaeberg, Cape Town, 8018.
Member Florist, defined as a company or individual that has signed a contract with Floristweb cc to supply and deliver products to Customers.
Florist Sites, defined as subsections of Floristweb.co.za where Member Florists advertise products, managed by the Member Florists.
Orders, defined as electronically submitted forms confirming a purchase of flowers or gifts with supplied credit card details.
Floristweb.co.za is protected by copyright as a compilation, the authorship of all works contained on this website including but not limited to all design, images, text and trademark, are owned by Floristweb and are protected by South African and international copyright laws and conventions. We reserve the right to take legal action in respect of any reproduction, adaptation, broadcast, publication or other communications to the public of any information contained on this website without the prior written consent of Floristweb.
a. Description of Service
Floristweb is an e-commerce portal that facilitates the sale of Flowers and Gifts to the general public by Member florists. Member Florists supply flowers and gifts that they advertise on their own individual webpages of the Floristweb website, at their advertised prices.
b. Conditions of Use
The Service may be used by any person or organization in any country, to purchase products such as flowers and gifts for delivery in South Africa. The Service must not be used for the following purposes:
Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material; Gaining unauthorised access to other computer systems; Interfering with any other person's use or enjoyment of the site; the purchase of any illegal products.
Floristweb reserves the right to suspend and/or delete any account that is not used in accordance with these conditions.
c. Agreement of Sale
On acceptance by us of your Order Form we will advise you by e-mail confirmation of your order for gifts and flowers. An agreement of sale will come into effect between Floristweb and yourself when confirmation of the credit card authorisation is received by Floristweb. When orders are placed with Member florists on a weekend or public holiday the order will be processed the next working day. Please see individual florist sites for opening times and flower delivery times. Floristweb reserves the right to refuse to accept and/or execute an order of flowers and gifts in whole or in part, but this will be reserved for exceptional circumstances only.
d. Availability of Service
We cannot guarantee the flower and gift order service to be available at all times, but will endeavour to take all possible and reasonable steps to keep the service available. Routine maintenance, natural disasters and other unforeseen circumstances beyond our control are possible factors in the unavailability of the flower and gift ordering service.
All prices include VAT.
Prices listed on the Floristweb member sites are valid for 14days of submitting your flower and or gift order.
Prices listed for flowers or gifts on the Florist member sites are their own prices over which Floristweb cc. has no control.
a. Product quality
All products including all flowers and all gifts are supplied by Member florists; they are bound by contract to deliver quality flowers and gifts to customers. If the quality of products delivered is not acceptable, the member florist will replace the order; if this is still not satisfactory Floristweb will refund the money in full.
b. Product availability
All Member Florist products are subject to availability. In the event of any supply difficulties, member florists reserve the right to substitute an advertised flower product with one of equivalent value and quality without notice. In the event that we are unable to supply the flower product in question or any substitute flower product to you at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date.
We agree to use all reasonable endeavours to ensure that the delivery of your flower and gift order will be on the requested delivery date or during the delivery period. You acknowledge that the actual delivery will be done by a local independant Floristweb Member Florist. Florists are required by contract to deliver the ordered products in the timeframe allowed. If an AM delivery is chosen, this means between 8am and 12:30pm, if a PM delivery is selected, this means between 12pm and 6pm. During peak periods, delivery can be as late as 9pm. In the case of delivery to certain locations where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. If the recipient is unavailable, it is considered normal and acceptable practice to deliver the products to a neighbour or work colleague that is available to accept and sign for the delivery.
If a remote area is selected where there is no delivery coverage by Floristweb member Florists, we will ask the nearest florist if delivery is possible and you will be advised of additional courier charges as soon as possible, upon receipt of your order form.
Incorrect personal details and contact numbers will lead to problems and delays in delivery, whilst we endeavour to correct these details to complete the delivery of your flowers and/or gift product.
d. Cancellations and Amendments to Orders
Orders may be cancelled or amended up to the close of business (usually 5pm) the day before the intended delivery. If the delivery date follows a non-working day, the last working day prior to the delivery date will be considered the last day when cancellations or amendments are accepted. To cancel or amend your order, please contact the Floristweb Customer Service Team from 8am until 6pm Monday to Saturday on the numbers or email addresses found on the Contact Floristweb page. We are able to make small amendments to orders before the order leaves Member Florist’ premises, however, if your order is en route or already delivered, no amendments can be made. A handlling fee of 25% is incurred on orders cancelled or part thereof. All refunds are made 7 working days after deposit.
5 Privacy and Security
In general, you can visit Floristweb.co.za or any of the Member Florist sites without telling us who you are or revealing any personal information about yourself. We do however collect two types of information about our visitors: Non-Personal information such as details about your browser software, IP address and operating system. We also collect personal information when you sign up for a customer account which may consist of your Name, address, telephone number, email address, billing information (credit card number, expiration date and billing address), occasion type (Valentine's Day, etc.) and any products purchased.
We use non-personal information to ensure that we are providing the best possible service to you, our customers, and to make sure that our site remains online and accessible at all times.
We will only use your personal information for internal purposes, such as confirming and tracking your order, registration of accounts, analyzing trends and statistics, and informing you of our new products, services and offers. Personal Information is compiled by us and analyzed on both a personal and an aggregated basis. We will never sell any of this information on to third parties or service providers, and if you wish to modify or remove any information from our database please contact us at any time.
From time to time we may contact you to inform you of promotional items or events that we feel you may want to hear of. This communication will be limited and will only be from Floristweb. If you wish to opt out of receiving any further communications from us, simply reply to us with ‘unsubscribe’ in the subject line.
We endeavour to keep all of your information as secure as possible, and employ the most practical and efficient security software on our internet servers. All transactions are encrypted before they are transmitted to our site for payment authorisation. When you register as a customer you will be required to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your account. If you know or suspect that someone else knows your password you should notify us immediately. Should you forget your password, please use the ‘forgot your password’ page linked from the homepage to generate a new password, this will be emailed to your registered email address.
Whilst we agree to use all reasonable resources to ensure that the Floristweb site is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the Floristweb site and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Floristweb site impossible or impractical.
As we rely on our Member Florist network to actually supply products to our customers, if a said Member Florist breaches their contract with us, we will be forced to cancel any existing orders you have placed with us for the said Member Florist. A replacement Member Florist will be found to supply and deliver the order and complete the transaction for you.
We shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.
Floristweb cc does not accept liability for death or personal injury arising from our negligence or the negligence of our member florists.
We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Floristweb Site from time to time. We will post any changes on the Floristweb Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Floristweb site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions. Additionally, we reserve the right to suspend, restrict or terminate access to the Floristweb site for any reason at any time.
These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Floristweb site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Save in respect of fraudulent misrepresentation, this agreement (including) any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
Your purchase will be deemed to have occurred in South Africa. These Terms and Conditions shall be governed by and construed in accordance with South African Law and the parties agree to submit to the exclusive jurisdiction of the South African courts.
